Terms of Service (Align)

These Terms of Service (“Terms”) govern your use of Align (the “Service”), including the website and web app (“Web App”) and the iOS/Android mobile apps (“Mobile App”). By accessing or using the Service, you agree to these Terms.

1) Eligibility

1.1 You must be at least 16 to use the Service. If you are under that age, you may not use the Service.

1.2 You represent that you have the legal capacity to enter into these Terms.

2) The Service

2.1 Align provides tools to create and coordinate group events and availability, optionally including calendar-based busy-time snapshots on mobile devices.

2.2 The Service is currently provided as free / non-commercial (no payments or subscriptions) as of the date above.

2.3 We may add, modify, or remove features at any time.

3) Accounts and guests

3.1 Accounts. You may use Align with a display name and optionally upgrade with an email address and password. You are responsible for maintaining the confidentiality of your credentials.

3.2 Accurate information. Your display name may be a nickname and does not need to be your legal name, but you must not impersonate others or mislead participants.

3.3 Guest participation. Guests may join events without creating an account by providing a display name and availability.

3.4 Invite links. Events may be accessible via an invite link or code. Anyone who has the invite link/code may be able to join the event and view the event details and participant availability for that event. You are responsible for sharing invite links/codes only with people you intend to invite.

3.5 Account security. You agree to notify us promptly of any unauthorized use of your account.

4) User content and permissions

4.1 Your content. You retain ownership of content you submit to the Service, such as event details and availability (“User Content”).

4.2 License to operate the Service. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and display your User Content solely to provide and improve the Service.

4.3 Event sharing. Availability and participant information is shared only with participants of the relevant event.

4.4 Calendar access (optional). If you enable calendar permissions on the Mobile App, the app may read event metadata and upload busy-time snapshots as described in the Privacy Policy.

5) Acceptable use

You agree not to:

  • use the Service for unlawful, harmful, or abusive purposes
  • harass, threaten, or defame others
  • impersonate another person or misrepresent your identity
  • attempt to gain unauthorized access to systems or data
  • interfere with or disrupt the Service (e.g., via scraping, flooding, denial-of-service)
  • reverse engineer or circumvent access controls (except where legally permitted)

We may suspend or terminate access for violations.

6) Intellectual property

6.1 The Service, including software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws.

6.2 These Terms grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.

7) Privacy

Your use of the Service is also governed by the Privacy Policy. The Privacy Policy explains what data we process and how.

8) Availability, changes, and maintenance

8.1 We aim to provide reliable service, but uptime is not guaranteed.

8.2 We may perform maintenance, suspend, or discontinue the Service (in whole or part) at any time.

8.3 We may update these Terms. Continued use after the effective date means you accept the updated Terms.

9) Termination

9.1 By you. You may stop using the Service at any time.

9.2 By us. We may suspend or terminate your access if you violate these Terms, or if we need to protect the Service, users, or third parties.

9.3 Effect of termination. We may delete or retain data according to the Privacy Policy and applicable law.

10) Disclaimers

10.1 Service provided “as is”. The Service is provided on an “as is” and “as available” basis.

10.2 No warranties. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10.3 Scheduling decisions. Align provides suggestions based on availability data; it does not guarantee correctness, completeness, or that a suggested time works for everyone.

11) Limitation of liability

11.1 To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption.

11.2 Liability cap. To the maximum extent permitted by law, our total liability under these Terms is limited to EUR 50. This cap does not apply where liability cannot be limited under applicable law.

11.3 Mandatory law. Nothing in these Terms limits liability where it cannot be limited under applicable law (e.g., intent, gross negligence, liability for death/personal injury, mandatory product liability).

12) No indemnity

We do not require a general indemnity from consumers for normal use of the Service. Nothing in these Terms limits any rights or remedies available under applicable law.

13) Governing law and jurisdiction

13.1 Governing law. These Terms are governed by the laws of Germany, excluding conflict-of-law rules.

13.2 Jurisdiction. Courts located in Frankfurt am Main, Germany shall have jurisdiction, unless mandatory consumer rules require otherwise.

13.3 EU consumer rights. If you are a consumer in the EU/EEA, you may benefit from mandatory consumer protections in your country of residence.

15) Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

16) Entire agreement

These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
